(a) The £80 'special rate' figure. Newcastle Borough Council stated that they had NEVER agreed to any special rate, we are also in possession of a letter signed by the Chief Executive of the National Association of Monumental Masons stipulating that if any agreement had been made between Newcastle Borough Council and the masons, that it appeared to be "out of the window".
(b) In the survey the "Finger Pressure Test" was employed. Any 'test' that was designed was meant for headstones that already utilised the method of 'ground bolting', which was not applicable in this case.
However, these inaccuracies does not affect the legality of the situation, and in view of Mr. Lowe's report the matter of taking the issue to judicial review is not appropriate at present. The suggested alternative options were as follows:
(a) Arbitration - this option would appear unacceptable, a totally independent arbitrator would be required NOT the National Association of Monumental Masons.
(b) MALADMINISTRATION via the Ombudsman - in the council's surveys conducted since 1994 it was their administrative practice to give a period of notice.
In conclusion, Newcastle Cemetery Action Group members will be pursuing justice via the Ombudsman, all relevant evidence & information has been provided. - Progress report expected within approx. 3 weeks.
We will endeavour to secure a copy of the report supplied to the Q.C. by the National Association of Monumental Masons for clarification of its contents.
